Conditions of Use
By obtaining and using a DCTAG, User agrees to be bound by and accepts the following terms and conditions of this Agreement, and acknowledges having read and understood this entire Agreement.

When you activate the DCTAG for the first time you are agreeing to be bound by these Conditions of Use. These Conditions of Use should be read carefully. We suggest that you seek advice if you do not understand any of the information contained within these Conditions of Use or how they apply to you. Once you use your DCTAG for the first time you will be deemed to have accepted these Conditions of Use and they will apply to the use of your DCTAG.
The conditions of use apply to all transactions initiated by you through an Electronic Banking Terminal (which in these Conditions of Use refers to eftpos devices by the combined use of your DCTAG and a Personal Identification Number (PIN) (for transactions over $100) effected with the use of your DCTAG.
If you fail to properly safeguard your DCTAG or your PIN you may increase your liability for unauthorised transactions and may be held liable for unauthorised use of your DCTAG.
Your DCTAG is issued to you by Indue Limited ABN 97 087 822 464 (“Indue”) (referred to hereafter as “Issuer”). The Issuer is an authorised deposit-taking institution and a member of Visa and has appointed DC Payments as a third party agent of Issuer (referred to hereafter as “Distributor”).
By accepting these Conditions of Use, you are entering into a contract with Issuer. The Issuer as the issuer of your DCTAG is responsible for effecting settlement of all transactions that arise as a result of you using your DC TAG in accordance with the terms set out in these Conditions of Use.
The Distributor is the distributor and promoter of your DCTAG. The Distributor is also responsible for providing certain cardholder services to you. These services include providing you with your DCTAG, arranging for replacement DCTAGs to be issued to you in accordance with the terms of these Conditions of Use, providing lost and stolen services and assisting you with any enquiries you may have regarding your use of DCTAG.
ACTIVATING YOUR DCTAG
Having received your DCTAG, you will be required to activate it before being able to use it. To activate your DCTAG you will need to go online at
and follow the prompts.
PERSONAL IDENTIFICATION NUMBER (PIN) SECRECY
When you purchase your DCTAG as part of the online activation process you will be required to create a PIN electronically.
You must safeguard your PIN.
Failure to properly safeguard your PIN may increase your liability for unauthorised use. You should examine your DCTAG activity regularly to identify and report any instances of unauthorised use.
If you forget your PIN, you are able to reset it by going online to
and following the prompts. If an incorrect PIN is entered three times when a transaction is attempted using your DCTAG, it will be temporarily suspended for up to 24 hours.
You are able to load funds onto your DCTAG by using electronic funds transfer (also known as Pay Anyone) through your Australian financial institution.
To load funds via Pay Anyone, use the BSB (the six digit bank sub branch number) and account number that is provided when you activate your DCTAG. The BSB and account number is provided on the surrounds of the plastic mini-card provided to you with your DCTAG.
After you conduct a load through your financial institution, it can take up to 3 Business Days for your funds to be available for use on your DCTAG.
The total amount that may be loaded onto your DCTAG in any one transaction via Pay Anyone cannot exceed $500 (five hundred dollars) and the total Balance that may be stored onto to your DCTAG at any one time cannot exceed $500 (five hundred dollars).
Any attempted load that would take your DCTAG Balance over $500 at any one time will be rejected and the amount of the attempted load will be returned to your financial institution.
The Monthly Account Fee will be deducted from any Balance loaded onto your DCTAG.
You must always load sufficient Balance to pay the Monthly Account Fee.
If, following activation, your DCTAG is not used for any period of time you will still be charged the Monthly Account Fee. If you do not have sufficient Balance to pay your Monthly Account Fee, the Distributor may, in its sole discretion, suspend your DCTAG without notice to you.
USING YOUR DCTAG
DCTAG can be used to purchase goods and services
wherever Visa payWave is accepted by a merchant. Purchases and payments can be made at any payment terminal which displays the Visa payWave logo, if there is sufficient Balance stored on the DCTAG.
If your transaction exceeds $100.00, you will be required to enter your PIN.
Some merchants may choose not to accept Visa payWave. Issuer and DC Payments do not warrant or accept any responsibility if a merchant does not accept your DCTAG. You should always check with the merchant that it will accept Visa payWave before you attempt to purchase any goods or services.
Your DCTAG can’t be used to conduct online transactions or to withdraw cash at ATMs.
When you use the DCTAG, the amount of the purchase plus any fees charged by the merchant for the Electronic Transaction will be deducted from your available Balance. You cannot use your DCTAG to make or complete a transaction that exceeds the Balance that is stored on your DCTAG. Any attempted transaction that is in excess of the Balance stored on your DCTAG will be rejected.
In some circumstances (for example, where a transaction is processed in an offline environment or where you incur a fee or charge), the Balance remaining on your DCTAG may become negative (meaning there may become less than $0.00 Balance remaining on your DCTAG). In these circumstances, you’ll be liable for any negative balance that may result and in certain circumstances any reasonable costs the Issuer or the Distributor may incur in seeking the amount of the negative balance from you. If your DCTAG has a negative balance, when value is next loaded onto your DCTAG, we may first apply that loaded value to recover the negative balance from you.
You acknowledge and agree that you will not earn any interest on any Balance that is stored on your DCTAG.
The DCTAG may be used as many times as desired as long as the necessary Balance is available, the Expiry Date has not been reached and the DCTAG has not been suspended or cancelled.

Neither the Issuer nor the Distributor is responsible in the event that you have a dispute regarding the goods or services purchased using your DCTAG.
The DCTAG must not be used for illegal purposes, including the purchase of goods or services that are banned by any Australian law.
You must not resell your DCTAG to any third party.
Fraudulent transactions can occur on your DCTAG and in certain circumstances you may be liable for an unauthorised transaction. Please refer to paragraphs 12 below.
The Financial Claims Scheme (FCS) is a scheme administered by the Australian Prudential Regulation Authority (APRA) to protect depositors from potential loss due to the failure of institutions. It provides depositors with a guaranteed protection, up to a cap. As at the date of these Conditions of Use, the FCS applies to deposits only. It does not extend to prepaid card products (including the DCTAG and any Balance held on the DCTAG). If the Issuer fails any Balance held on your DCTAG will not be protected by the FCS and you may lose all or part of your Balance. For more information on the FCS, refer to:
YOUR DCTAG CANNOT BE USED OUTSIDE AUSTRALIA
As at the date of these Conditions of Use, the DCTAG can’t be used to conduct transactions outside of Australia. Should the DCTAG have this functionality in the future, we will notify you by placing a notice on the Website at
and provide you with specific terms and conditions applicable to international transactions.
REPORTING THE LOSS OR THEFT OF YOUR DCTAG
A DCTAG can be used without a PIN to make purchases under $100. You are solely responsible for the care and control of your DCTAG. You must take reasonable care to keep your DCTAG safe from loss, theft or misuse.
You must notify the Distributor as set out below as soon as you learn of the loss, theft or misuse of your DCTAG. If you do not notify the Distributor as is reasonable having regard to your circumstances, then you may become liable for any losses occurring on your DCTAG. Please refer to paragraph 12 below.
You must not allow any person other than yourself to use your DCTAG. If you allow someone else to use the DCTAG, you will be liable for all resulting transactions and any fees and losses incurred as a result of the use by that person.
If you believe your DCTAG or PIN record has been lost or stolen, or your PIN has become known to someone else, you should IMMEDIATELY logon to
and select “lost and Stolen DCTAGs” and follow the prompts. This will place a stop on your DCTAG.
If you believe your DCTAG or PIN record has been lost or stolen, or your PIN has become known to someone else, you should
report this by contacting DC Payments on 1800 301 100.
Upon successful suspension of your DCTAG, all transactions will be blocked.
Procedure – DCTAG Suspension
After a stop has been placed on your DCTAG, you will not be able to, and you must not attempt to, use your DCTAG until you have spoken with the Distributor to reactivate your DCTAG (even if you have found your DCTAG).
After your DCTAG has been suspended and remains inactive for three months the Distributor, it its sole discretion, may cancel your DCTAG without notice to you. In these circumstances the Distributor will make reasonable endeavours to contact you using your last-known contact details and arrange for any Balance to be transferred by electronic funds transfer to your nominated bank account.
Procedure – DCTAG Replacement
If you require a replacement DCTAG you will need to go online at
and follow the prompts to purchase a replacement DCTAG. Standard rates and charges for that purchase apply which can be found at
and which are paid directly to the Distributor and not the Issuer.
Once a replacement DCTAG is purchased by you, the Balance remaining on your lost or stolen DCTAG will be transferred to your new DCTAG.
FEES AND CHARGES
The following standard fees and charges apply. You agree to pay to the Issuer all fees and charges that are set out in these Conditions of Use. The Issuer will deduct these fees and charges from your DCTAG by deducting the amount of the fee or charge in accordance with these Conditions of Use. All fees and charges that are set out in this agreement are inclusive of any GST.
If you consider the Issuer has incorrectly charged you a fee or charge, you may dispute this by contacting DC Payments in the first instance in accordance with these Conditions of Use. Any fee which the Issuer determines has been incorrectly charged will be reversed by the Issuer.
FEES AND CHARGES
Monthly Account Fee:
$6.00 per month. This fee is deducted from your DCTAG Balance on the 1st business day of each month. In the event that you have transactions pending (being transactions that have been made on your DCTAG but have not yet been processed by the merchant) at the time your Monthly Account Fee is deducted from your DCTAG Balance, the Balance remaining on your DCTAG may become negative (meaning there may be less than $0.00 Balance remaining on your DCTAG). If your DCTAG has a negative balance, when value is next loaded onto your DCTAG, we may first apply that loaded value to recover the negative balance from you.
The DCTAG is valid until the Expiry Date. The Expiry date is printed on the plastic mini-card that inserts into your bracelet and is also available when you log into the Website at
You must use all available Balance by the Expiry Date.
Prior to the Expiry Date you may contact DC Payments and request that the Balance be transferred by electronic funds transfer to your nominated bank account.
If you have not made prior arrangements before the Expiry Date of your DCTAG on the Expiry Date we will stop your DCTAG. No Monthly Account Fee will be deducted from the Balance after the Expiry Date.
You must not use your DCTAG after the Expiry Date.
In order for the Distributor to send you a replacement DCTAG please contact the Distributor 30 days before Expiry Date or any time after the Expiry Date on 1800 301 100 and the Distributor will issue a new DCTAG at no charge. You must destroy your expired DCTAG (being the plastic mini-card) by cutting it diagonally in half.
If you have not requested a replacement DCTAG and value still remains on your DCTAG after 7 years from the Expiry Date (or such other period of time provided for by the law), Issuer will transfer the value on your DCTAG to the Commonwealth Government as “unclaimed money”. Before Issuer transfers the balance to the Commonwealth Government as “unclaimed money”, reasonable endeavours will be made to contact you using your last-known contact details.
You have the right to claim your money that is held with the Commonwealth Government. Please refer to ASIC’s website at
CANCELLATION OF YOUR DCTAG
The DCTAG always remains the property of the Issuer.
The Issuer or Distributor may cancel and demand the return of your DCTAG issued to you at any time:
for security reasons and to protect any remaining Balance where your DCTAG has been or is suspected by Issuer or DC Payments to have been compromised; or
if you breach these Conditions of Use and the Issuer acting reasonably considers the breach to be material.
If these circumstances arise, the Issuer or Distributor will notify you and refund any remaining Balance held on your DCTAG at the time of cancellation.
You may cancel your DCTAG at any time by giving the Distributor notice. If you cancel your DCTAG you will need to go online at
and follow the prompts.
If on the cancellation date Balance remains on your DCTAG you may contact the Distributor and request that the Balance be transferred by electronic funds transfer to your nominated bank account.
You will continue to be liable to the Issuer for the value of any transactions made prior to you cancelling your DCTAG.
YOUR LIABILITY IN CASE YOUR DCTAG IS LOST OR STOLEN OR IN THE CASE OF UNAUTHORISED USE
You must keep your DCTAG secure at all times and treat it as you would treat cash. If the Issuer reasonably determines, based on substantial evidence that you were fraudulent or grossly negligent in the handling of your DCTAG, you will be liable for any loss you may incur from any unauthorised use resulting from a lost or stolen DCTAG. Unless exceptional circumstances exist, you will ordinarily be liable for any loss arising from the use of your DCTAG where:
you unreasonably delayed notification of:
your DCTAG being lost or stolen;
unauthorised use of your DCTAG;
the fact that someone knows, or you suspect might know, your PIN;
you allowed someone else to use your DCTAG;
you voluntarily disclosed your PIN to anyone, including a family member or friend; or
you voluntarily allowed someone else to observe
You may also be liable for any unauthorised use where you fail to provide all documentation reasonably requested by the Issuer or DC Payments, which may include provision of a statutory declaration and police report.
The above is not an exhaustive list of circumstances where you will be liable for unauthorised uses of your DCTAG. There may be other circumstances where the Issuer reasonably determines, based on substantial evidence, that you were fraudulent or grossly negligent in the handling of your DCTAG.
Where you are not liable for an unauthorised transaction, the Issuer will endeavour to refund the amount of the unauthorised transaction within five (5) days unless the Issuer determines that additional investigation is warranted based on prior usage of the DCTAG or the nature of the unauthorised transaction.
RESOLVING ERRORS ON ACCOUNT STATEMENTS
If you have a complaint or dispute relating to your DCTAG, you should contact Distributor on 1800 301 100.
If you have a complaint or dispute that is not satisfactorily resolved by the Distributor, you should contact the Issuer. The Issuer will acknowledge your communication within five Business Days and will advise you of an outcome within forty five days maximum. The Issuer will keep you up-to-date with any progress or developments in accordance with its internal dispute resolution procedures. The Issuer may be contacted by phone: 1300 671 819 between 7.00am – 7.00pm Monday to Friday, Saturday 8:00am – 7:00pm, closed Sundays and national public holidays.
ANTI-MONEY LAUNDERING AND COUNTER-TERRORIST FINANCING
You acknowledge and agree that:
where required, you will provide the Issuer and Distributor all information reasonably requested by the Issuer and Distributor in order for it to comply with the fraud monitoring and anti-money laundering and counter terrorism financing obligations imposed on it pursuant to the AML Legislation or the Visa scheme rules;
participation in the Visa scheme rules may impose other countries laws such as the US Patriots Act;
The Issuer and Distributor may be legally required to disclose information about you to regulatory and/or law enforcement agencies;
The Issuer and Distributor may block, delay, freeze or refuse any transactions where the Issuer or Distributor in its sole opinion considers reasonable grounds exist to believe that the relevant transactions are fraudulent, in breach of the AML Legislation, the Visa scheme rules or any other relevant law;
where transactions are blocked, delayed, frozen or refused by Issuer in accordance with this condition you agree that Issuer is not liable for any loss suffered by it or other third parties arising directly or indirectly as a result of the Issue or Distributor taking this action; and
The Issuer will monitor all transactions that arise pursuant to your use of the DCTAG in accordance with its obligations imposed on it in accordance with the AML Legislation.
CHANGES TO CONDITIONS OF USE
We may change, add to or delete the terms and conditions set out in these Conditions of Use at any time (including to introduce new fees).
Where the change involves an increase in fees or charges, or an increase in the risk associated with the DCTAG or may otherwise be detrimental to you, we will provide you with at least 30 days’ notice by publishing a notice on
. If you wish to cancel your DCTAG as a result of any such change or variation, you must contact DC Payments on 1800 301 100. In these circumstances you will not be charged a fee for cancellation and any Balance on your DCTAG will be transferred by electronic funds transfer to your nominated bank account.

PRIVACY AND INFORMATION COLLECTION
The Issuer and Distributor may collect your personal information:
to identify you in accordance with the AML Legislation and Visa scheme rules;
to provide information about a product or service;
to consider your request for a product or service;
to provide you with a product or service;
to assist in arrangements with other organisations in relation to the provision of a product or service or suspend its operation until it is provided;
to perform administrative and operational tasks (including systems development and testing, staff training, and market or customer satisfaction research);
to prevent or investigate any fraud or crime (or a suspected fraud or crime); and
as required by relevant laws and scheme rules.
In some circumstances, the Issuer and Distributor may collect your personal information from a third party service provider. They may also collect information from other participants in the payments system in order to resolve disputes or errors arising from the use of your DCTAG.
the Issuer and Distributor may provide your information:
to another member of its group;
to any outsourced service providers (for example mailing houses, fraud and anti-money laundering service providers, data switch service companies);
to regulatory bodies, government agencies, law enforcement bodies and courts;
to other parties as is authorised or required by law; or
to participants in the payments system and other financial institutions for the purpose of resolving disputes, errors or other matters arising out of your use of your DCTAG or third parties using your DCTAG.

In accordance with the Privacy Act 1988 (Cth), DC Payments and Issuer must comply with the Australian Privacy Principles. You have the right to lodge a complaint if you believe Issuer or DC Payments has breached the Australian Privacy Principles. For details on how you may complain about a breach and how Issuer and DC Payments deals with complaints, please refer to Issuer’s and DC Payments’ privacy policies at
means the Anti-Money Laundering and Counter Terrorism Financing Act 2006 (Cth) and its associated rules, regulatory guides and regulations.
means the monetary value of funds transferred by you and stored on your DCTAG from time to time (expressed in Australian Dollars).
means a day that banking institutions are open in Brisbane, excluding Saturday, Sunday and public and bank holidays.
means the total Balance that may be stored on your DCTAG at any one time, which as at the date of these Conditions of Use, is $500.
means the Visa Wearable Payment Product (being the plastic mini-card inserted into the bracelet) issued by Issuer at the request of DC Payments.
means Electronic Funds Transfer Point of Sale.

means a transaction: (i) initiated by your instruction to purchase goods and/or services using the DCTAG and your PIN (for transactions over 100); (ii) arising from use of your DCTAG; or (iii) arising from use of information stored on your DCTAG.
means the expiry date of your DCTAG printed on the plastic mini-card that inserts into your bracelet and available when you log into the Website at
Monthly Account Fee
means the fee described in clause 9 of these Conditions of Use.
means the Personal Identification Number required to be entered by you when using DCTAG for Electronic Transactions over $100. The PIN is set by you at the same time you activate your DCTAG and may be changed by you from time to time.
means that additional value may be loaded onto your DCTAG from time to time in accordance with these Conditions of Use and provided that the Balance stored on your DCTAG does not exceed the DCTAG Limit.
means Visa Worldwide PTE.
refers to the contactless method by which your DCTAG may be used to complete a transaction by waving the DCTAG over a merchant’s Visa payWave enabled point of sale terminal, without the need for a PIN or signature.

The Contactless Indicator is owned by EMVCo, LLC ("EMVCo"). EMVCo has licensed the Contactless Indicator to Visa pursuant to a Trademark License Agreement (the "TMLA"), under which Visa has rights to sublicense the Contactless Indicator to its Members. Subject to the terms and conditions of the TMLA, Visa grants to each Member a non-exclusive, non-transferable, revocable license to use the Contactless Symbol only in conjunction with the applicable Visa Programs that are licensed to the Member

the singular includes the plural and the plural includes the singular;
a party named in these Conditions of Use includes the party’s executors, administrators, successors and permitted assigns;
money is referring to Australian Dollars unless otherwise stated;
“Including” and similar expressions are not words of limitation;
where a word or expression is given a particular meaning, other parts of speech and grammatical forms of that word or expression have a corresponding meaning;
headings and any table of contents or index are for convenience only and do not form part of these Conditions of Use or affect its interpretation; and
if an act must be done on a specified day which is not a Business Day, it must be done on the next business day.
